These Terms of Use ("Terms") govern your access to and use of SpeakLink (the "App"), provided by SpeakLink / ESLAN Services ("we", "us", or "our"). By accessing or using the App, you agree to these Terms.
1. Eligibility
You must be able to form a legally binding contract in your jurisdiction to use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts and access
- You are responsible for maintaining the confidentiality of your account and for all activity under your account.
- You must provide accurate information and keep it up to date.
- We may suspend or terminate access if we reasonably believe your account is being used unlawfully or in breach of these Terms.
3. Subscriptions, purchases, and payments
a) SpeakLink Pro (Subscription)
SpeakLink Pro is a recurring subscription service. By purchasing SpeakLink Pro, you authorize us (via our payment provider) to charge the applicable subscription fee on a recurring basis (e.g., monthly or annually, as displayed at checkout) until cancelled.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time via the Billing section of the App. Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused time.
b) Career Programs (One-Time Access)
Career Programs (including but not limited to Nursing, Hospitality, Construction, and other career-specific programs) are sold as one-time purchases granting access for a fixed period of 12 months from the date of purchase, unless otherwise stated at checkout.
Access automatically expires at the end of the access period. Career Program purchases do not auto-renew.
c) No Refunds
Except where required by applicable law (including the Australian Consumer Law), all payments are final and non-refundable.
We do not provide refunds or credits for change of mind, failure to use the App, partial subscription periods, early cancellation, or expiry of access after the fixed access period.
Nothing in these Terms excludes, restricts, or modifies any rights you may have under applicable consumer protection laws.
d) Payment processing
Payments are processed by third-party providers (such as Stripe). We do not store full payment card details. Your payment information is subject to the payment provider’s terms and privacy policies.
4. Acceptable use
- Use the App for unlawful, harmful, or abusive purposes.
- Attempt to reverse engineer, exploit, or disrupt the App or its infrastructure.
- Upload or submit content that infringes intellectual property rights, violates privacy, or is offensive or discriminatory.
- Circumvent access controls or paid feature gating.
5. Educational nature; no guarantees
SpeakLink provides language practice and feedback tools for educational purposes only. We do not guarantee specific outcomes, scores, or improvements.
6. Audio, scoring, and AI services
The App may use third-party services to generate audio and provide pronunciation scoring or feedback. Results can vary and may not be error-free. You are responsible for how you interpret and use any feedback.
7. Intellectual property
The App, its design, branding, and all related materials are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written permission.
8. User content
If the App allows you to submit content (including recordings), you retain ownership of your content. You grant us a limited license to host, store, process, and display that content solely to operate, improve, and provide the requested functionality of the App.
9. Third-party links
The App may link to third-party websites or services. We are not responsible for third-party content, policies, or practices.
10. Disclaimer
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising from your use of the App.
12. Suspension and termination
We may suspend or terminate access to paid features if payment is declined or reversed, a chargeback is initiated, fraudulent activity is suspected, or you materially breach these Terms.
13. Changes to the App and Terms
We may update the App and these Terms from time to time. If changes are material, we will update the "Last updated" date. Continued use of the App after changes means you accept the updated Terms.
